Judge James Donato tosses Trump lawsuit against Twitter

A federal judge in San Francisco tossed a lawsuit from former President Trump against Twitter because of its decision to ban him from the platform after the January 6 riots in Washington D.C.

In his suit, Trump alleged that Twitter and other social media companies which moved to curb his speech were acting as de facto government agents and were therefore infringing on his first amendment rights.

“The amended complaint does not plausibly allege a First Amendment claim against Twitter,” said U.S. District Court Judge James Donato in a 17 page ruling Friday. Donato was appointed to the bench by former President Obama.

Two other lawsuits, against Facebook and YouTube, remain ongoing. Twitter declined to comment. Reps for Trump did not immediately respond to request for comment.

The suit may have been moot even before its dismissal after Tesla boss Elon Musk announced plans to buy Twitter for $44 billion.

The mercurial billionaire has said he wants promote free speech and cut back on censorship which has long plagued the platform.

There has been wide speculation Trump could made a return, though the former president has said it’s not happening.
