Sarah Palin's suit against NYT to go to trial after COVID delay

Sarah Palin’s defamation suit against the New York Times is set to go to trial in Manhattan Thursday after it was delayed for more than a week due to her recent COVID-19 infection.

The former Alaska governor said she’s feeling “really good” after her bout with the coronavirus and about her case against the Gray Lady. 

“I’m clear to go and never had any symptoms,” she said before walking into the courtroom at about 8:35 a.m. 

Palin, 57, sued the newspaper in 2017, claiming the Times defamed her in an editorial headlined “America’s Lethal Politics” about recent mass shootings in the US. 

The former GOP vice presidential candidate alleged in the complaint that the piece linked her political action committee to a mass shooting in Arizona that wounded Rep. Gabby Giffords. 

In a correction to the editorial, the Times said the piece “incorrectly stated that a link existed between political rhetoric and the 2011 shooting.”

Palin’s suit names the newspaper and James Bennet, the former editorial page editor, as defendants. 

To win the case, Palin will have to prove the newspaper and Bennet acted with “actual malice” or “reckless disregard” for the truth when they published the editorial. 

“In this trial we are seeking to reaffirm a foundational principle of American law: public figures should not be permitted to use libel suits to punish unintentional errors by news organizations,” a spokesperson for the Times said in a statement.

“We published an editorial about an important topic that contained an inaccuracy. We set the record straight with a correction,” the spokesperson added.

The trial was supposed to kick off last Monday, but was postponed after the former GOP heavyweight tested positive for COVID-19. 

Palin has said publicly that she’s unvaccinated and told a conservative radio host that it would be “over my dead body that I’ll have to get a shot.”

Page Six reported last week that Palin has been dating former Rangers player Ron Duguay, 64. 

On Thursday, Palin was wearing a court-required N-95 mask as she rode the elevator up to her courtroom on the 24th floor. She carried another cloth mask in her hand that had a Rangers logo on it.
